These Terms and Conditions ("Terms") govern your access to and use of Anomaly’s websites, apps, and related services (the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who We Are

Anomaly Health Inc. ("Anomaly," "we," "us") provides consumer-directed wellness and lifestyle planning tools, including software features that help you organize health information and plan next steps.

2. Canada and United States Only

The Services are intended for use only by individuals located in Canada or the United States. You represent and warrant that you are located in Canada or the United States when using the Services. We may suspend or terminate access if we believe you are using the Services outside these countries.

3. Eligibility

You must be at least 18 years old to use the Services.

4. Not Medical Care; No Emergencies

The Services provide wellness and lifestyle-related information for educational and informational purposes only.

We do not provide medical advice, diagnosis, treatment, prescriptions, or emergency services.

Do not use the Services for emergencies. Call 911 (or your local emergency number).

You agree that you are responsible for your decisions and for seeking professional care from licensed clinicians and your primary care physician (PCP) as appropriate.

5. Independent Clinicians and Optional Sessions

The Services may allow you to request or schedule virtual sessions with independent clinicians ("Independent Clinicians").

  • Independent Clinicians are independent contractors or third parties, not Anomaly employees.
  • Any clinical services are provided by the Independent Clinician (and/or their practice entity), not by Anomaly.
  • Anomaly does not supervise or control the clinician’s professional judgment.
  • You understand that a clinician-patient relationship, if created, is between you and the Independent Clinician, not Anomaly.
  • Each Independent Clinician maintains their own professional liability insurance and is solely responsible for their clinical services and professional conduct.

6. System of Record

Anomaly is not the system of record for clinical documentation. Official visit notes, if any, are maintained by the Independent Clinician in their own EMR/EHR or record keeping system.

7. Account Registration and Security

You may need an account to access certain features.

You agree to:

  • provide accurate information and keep it updated;
  • maintain the confidentiality of your credentials;
  • notify us promptly at security@anomaly.health of suspected unauthorized access.

We may suspend or terminate accounts for suspected fraud, abuse, or violations of these Terms.

8. User Content and Permissions

You may upload or submit content, including health-related information ("User Content").

You grant Anomaly a limited, non-exclusive license to host, store, process, and use User Content solely to:

  • provide, maintain, and improve the Services;
  • comply with legal obligations;
  • enforce these Terms.

This license is consistent with our Privacy Policy and terminates when you delete your content or account (subject to retention requirements).

You represent that:

  • you have the rights to provide User Content;
  • providing User Content does not violate any laws or third-party rights.

9. AI Features and Limitations

Some features use AI and automated systems.

You acknowledge:

  • AI output may be inaccurate, incomplete, or inappropriate for your specific situation.
  • AI output is not medical advice, diagnosis, or treatment.
  • You will independently verify important information with qualified professionals.

We may use measures intended to improve safety and quality of AI-assisted features, such as automated filtering and monitoring. However, we do not guarantee that AI output will be accurate, complete, or safe for every use case. We do not use AI to provide diagnostic or treatment recommendations.

10. Prohibited Uses

You agree not to:

  • use the Services for emergencies or urgent care;
  • use the Services in a way that violates laws or regulations;
  • attempt to gain unauthorized access to systems or accounts;
  • interfere with the operation or security of the Services;
  • upload malware or harmful code;
  • misuse or scrape the Services at scale without permission;
  • use the Services to harass, threaten, or harm others;
  • impersonate others or misrepresent your affiliation.

11. Payments, Subscriptions, and Refunds (If Applicable)

If any paid Services are offered:

  • you agree to pay all fees and applicable taxes;
  • subscriptions may auto-renew unless canceled as described at purchase;
  • you can cancel subscriptions through account settings or by contacting hello@anomaly.health;
  • refunds (if any) will be described at checkout or in a posted refund policy;
  • we may change pricing with reasonable advance notice (at least 30 days for existing subscriptions).

12. Third-Party Services

The Services may integrate with third-party services (wearables, labs, portals) or include links.

  • Anomaly is not responsible for third-party services, content, availability, or practices.
  • Your use of third-party services is governed by their terms and policies.
  • We are not liable for issues arising from third-party service failures or data breaches, though we conduct diligence on integrated partners.

13. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference.

HIPAA and clinician privacy laws

Anomaly is not a healthcare provider or health plan. Depending on the circumstances, certain U.S. healthcare privacy laws (including HIPAA) may apply to Independent Clinicians and their practices, but may not apply to Anomaly’s consumer-directed Services. We nonetheless apply safeguards and handle personal information as described in our Privacy Policy and applicable privacy laws.

Key commitments
  • We do not sell your personal information or consumer health data.
  • We do not share your consumer health data with ad platforms for targeted advertising.
  • We maintain security safeguards to protect your information.
  • If we become aware of a security incident involving your personal information, we will provide notices as required by applicable law and without unreasonable delay, subject to any lawful delay required by law enforcement or to determine the scope of the incident.

14. Our Practices

We aim to:

  • maintain industry-standard security controls (encryption, access controls, monitoring);
  • conduct vendor diligence for Service Providers handling your data;
  • respond to security incidents with investigation, containment, and user notification consistent with applicable law;
  • notify you of material changes to these Terms or our Privacy Policy;
  • provide clear information about how we use your data;
  • make our subprocessor list available upon request;
  • work to maintain service availability and performance;
  • provide customer support channels for questions and issues;
  • continuously improve the Services based on user feedback.

These are practices and goals, not guarantees.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be:

  • uninterrupted or error-free;
  • completely secure from unauthorized access;
  • free from bugs, viruses, or other harmful components;
  • suitable for your specific situation or needs.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ANOMALY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

ANOMALY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

(A) CAD $100, OR
(B) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Important exceptions

These limitations do not apply to:

  • liability that cannot be excluded or limited by law;
  • fraud, gross negligence, or willful misconduct by Anomaly;
  • death or personal injury caused by our negligence;
  • consumer protection rights that cannot be waived.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Anomaly and its directors, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising out of:

  • your misuse of the Services;
  • your violation of these Terms;
  • your violation of laws or third-party rights;
  • your User Content.

This indemnification does not apply to claims arising from our breach of these Terms, our negligence, or our violation of applicable law.

18. Dispute Resolution

Informal resolution

Before filing any legal action, you agree to contact us at legal@anomaly.health to attempt to resolve the dispute informally. We aim to respond within 14 days and work in good faith toward resolution.

Governing law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law rules.

Venue

Subject to applicable consumer protection laws, disputes will be brought in the courts located in British Columbia. If you are a consumer, you may have the right to bring disputes in courts where you reside.

19. Termination

We may suspend or terminate your access if:

  • you violate these Terms;
  • you engage in fraud, abuse, or conduct that creates risk for the Services or others;
  • required by law or legal process.

You may stop using the Services at any time.

Upon termination:

  • your right to access the Services ends immediately;
  • you may request deletion of your data by contacting privacy@anomaly.health;
  • we will take steps to delete or de-identify your account data within a commercially reasonable period, typically within 30 days, subject to lawful retention requirements, backup systems, security logs, and legal holds.

20. Changes to Terms

We may update these Terms from time to time. The "Last Updated" date will reflect changes.

For material changes:

  • we will provide notice through the Services, via email, or other reasonable means at least 30 days before the changes take effect;
  • your continued use after changes means you accept the updated Terms;
  • if you do not agree to material changes, you may terminate your account.

21. General Provisions

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our consent.
  • Entire agreement: These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Anomaly regarding the Services.
